Welcome to DiGiFaMaR™ ("we," "our," or "us"). These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("user," "you," or "your") and Digital Farmers Marketplace, Inc., governing your access to and use of the DiGiFaMaR™ digital platform, including our website, mobile applications, and associated services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Platform.

1. Eligibility & Account Registration

To use the Platform, you must:

  • Be at least 18 years of age or the legal age of majority in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Platform under applicable laws

When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

2. User Obligations

You agree to:

  • Comply with all applicable laws, regulations, and these Terms
  • Provide accurate product descriptions if selling on the Platform
  • Maintain the quality and freshness of products as described
  • Respond to inquiries and orders in a timely manner
  • Not engage in any fraudulent, deceptive, or unlawful activity
  • Not attempt to circumvent our escrow or payment systems
  • Not infringe upon the intellectual property rights of others

Violations may result in account suspension, termination, or legal action.

3. Payments & Escrow

DiGiFaMaR™ utilizes an escrow payment system to protect both buyers and sellers:

  • Buyer: Payment is collected and held in escrow upon order confirmation
  • Seller: Funds are released to your account after buyer confirms delivery
  • Disputes: If a dispute arises, funds may be held pending resolution
  • Refunds: Subject to our Refund Policy, processed within 3-5 business days

All transaction fees are disclosed at checkout. By completing a purchase, you authorize the specified charge to your payment method.

4. Shipping & Delivery

Shipping terms vary by seller and are agreed upon at time of purchase:

  • Sellers are responsible for packaging products appropriately for transit
  • Delivery times are estimates and not guarantees
  • Buyers must provide accurate shipping addresses
  • Risk of loss transfers to the buyer upon delivery to carrier
  • Perishable items require temperature-controlled shipping where necessary

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • DiGiFaMaR™ provides the Platform "as is" without warranties of any kind
  • We do not guarantee the accuracy, completeness, or reliability of user content
  • We are not liable for any disputes between buyers and sellers
  • Our total liability shall not exceed the amount paid in fees in the 12 months prior to the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages

Some jurisdictions do not allow these limitations, so they may not apply to you.

6. Intellectual Property

The Platform and its original content, features, and functionality are owned by Digital Farmers Marketplace, Inc. and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.

7. Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your personal information. By using the Platform, you consent to the collection and use of information in accordance with our Privacy Policy.

8. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Platform immediately ceases.
